What does OSHA require for porta potties on a construction site?
OSHA 29 CFR 1926.51(c) requires toilets on every construction site. A site with 20 or fewer workers needs 1 toilet. A site with 20 or more workers needs 1 toilet seat and 1 urinal per 40 workers. A site with 200 or more workers needs 1 toilet seat and 1 urinal per 50 workers.
| Number of employees | Minimum number of facilities |
|---|---|
| 20 or fewer | 1 |
| 20 or more | 1 toilet seat and 1 urinal per 40 workers |
| 200 or more | 1 toilet seat and 1 urinal per 50 workers |
Exception in the rule: mobile crews with transportation readily available to nearby toilets do not need on-site units. Most Edinburg residential builders still rent one, because "nearby" rarely exists on a new subdivision lot.
What is the legal minimum versus what we recommend?
The OSHA minimum lets 20 workers share 1 toilet. With weekly service, 1 standard porta potty fills in about a week with 10 users. Mast Porta Potties recommends 1 unit per 10 workers, or a second weekly service, so the unit stays usable until the next pump-out.
Does OSHA require handwashing on a construction site?
OSHA 1926.51(f) requires washing facilities when construction work involves paints, coatings, herbicides, insecticides or other harmful contaminants. The facilities must be close to the work and kept clean, with soap and towels. Hand sanitizer alone may not satisfy the rule for those jobs.
Rent a hand washing station for painting, roofing coatings and chemical work.
What are the OSHA rules for farm field sanitation?
OSHA 29 CFR 1928.110 requires agricultural employers with 11 or more field workers to provide 1 toilet and 1 hand washing facility per 20 workers. Both must be within a quarter-mile walk of each worker or at the nearest vehicle access point. Potable drinking water is required too.

Does a general workplace without plumbing need toilets?
OSHA 1910.141 covers general industry and requires toilet facilities that workers can use promptly when needed. Warehouses, yards and outdoor businesses without working restrooms use porta potties to meet it. Size them with the same 1-per-10 rule for a weekly service schedule.
OSHA porta potty requirements questions
Does OSHA require separate men's and women's toilets?
OSHA requires separate facilities for each sex unless toilet rooms are single-occupancy and lock from inside. A standard porta potty locks from inside, so shared units meet that rule.
How far can the porta potty be from workers?
The construction rule does not set a distance, but toilets must be readily available. The farm rule sets a quarter-mile walk.
Who is responsible for OSHA toilet compliance?
The employer is responsible. On multi-trade sites, the general contractor usually provides the units. This page is general information, not legal advice.
Does Texas have its own jobsite toilet rule?
Texas private-sector workers fall under federal OSHA. Some city permits or contracts add their own conditions — check your permit.
